01Scope
These terms and conditions apply to all photography and video services provided by Vassily Rado (Vass.psv), for private individuals and businesses alike. 03Quote and order
Every project receives a free quote, sent within 48 to 72 hours of the initial call. It sets out the service, the date, the duration, the deliverables, the usage rights, any additional costs (travel, venue or equipment hire) and the price. A quote is valid for 30 days unless another period is stated.
The order becomes final once the accepted quote (signed, or accepted in writing by email) and the deposit have been received. The date is only reserved on receipt of the deposit. A booking made online counts as an order on the same terms.
04Prices
Prices are in euros including VAT at 20%; the pre-tax amount is shown for business clients. The prices on this site are starting prices: the final price is the one in the accepted quote.
Any travel outside the Île-de-France region, accommodation or hire costs are priced in the quote. No cost that is not in the quote may be charged without the client’s written agreement.
05Deposit and payment
A deposit of 30% of the price including VAT is paid when the quote is accepted. The balance is payable on delivery of the files, by the means stated in the quote and on the invoice. No discount is given for early payment.
The sum paid with the order is a deposit (acompte) and not a forfeitable down payment (arrhes) within the meaning of Article L214-1 of the French Consumer Code: the contract is binding on both parties, subject to the right of withdrawal and the cancellation terms below.
Business clients: any late payment automatically incurs penalties at the rate applied by the European Central Bank to its most recent refinancing operation plus 10 percentage points, together with a fixed €40 recovery fee (Articles L441-10 and D441-5 of the French Commercial Code).
06Rescheduling and cancellation
Rescheduling
The client may ask to reschedule the session once, free of charge, up to 7 days before the planned date. The new date is agreed together and the deposit is carried over to it.
Cancellation by the client
- More than 15 days before the planned date: the deposit is refunded in full.
- Less than 15 days before: the deposit is kept, in return for the reserved date and the preparation already carried out.
- Once the session has taken place, the full price is due.
These rules apply once the withdrawal period has ended: during that period, consumers have the rights described in section 07.
Cancellation by the service provider
If the service provider cancels, other than in a case of force majeure, the deposit is refunded within 14 days and the client also receives compensation equal to the amount of the deposit. A replacement date may be offered, which the client is free to refuse.
07Right of withdrawal
A consumer client has 14 days from the conclusion of the contract to withdraw, without giving any reason, when the contract is concluded at a distance (quote accepted by email, online booking, phone) or off premises (Articles L221-18 et seq. of the French Consumer Code). This right also applies to a business with no more than five employees, for a contract concluded off premises that falls outside its main activity (Article L221-3). It does not apply to other business clients.
How to withdraw
Before the period expires, send a clear statement by email to contact@vasspsv.com or by post, or use the model form below. Any sums paid are refunded within 14 days of receipt of the decision, using the same means of payment (Article L221-24).
Session scheduled within the 14 days
If the client wants the service to start before the 14 days are over, they must expressly ask for it in writing (when accepting the quote, or by email). If they then withdraw, they pay an amount proportionate to what was provided until they communicated their decision (Article L221-25). The right of withdrawal can no longer be exercised once the service has been fully performed before the end of the period, at the client’s express request and with their acknowledgement that they lose this right (Article L221-28, 1°).

08Production and delivery
Delivery times are stated in the quote: on average, from a few days to three weeks for photos and one to three weeks for video, from the session. Files are delivered digitally (gallery or download link); the number of images, the formats and the editing included are specified in the quote.
The choice of shots, framing and treatment is part of the service provider’s art direction, within the approved brief. Any concern about whether the deliverables match the quote should be raised in writing; corrections within the scope of the quote are made free of charge. The client is responsible for keeping a copy of the files delivered.
09Copyright and usage rights
Photographs and videos are protected works. Vassily Rado remains their author and retains the intellectual property in them (Articles L111-1 et seq. of the French Intellectual Property Code).
The quote specifies the usage rights granted: media (web, social media, print, advertising), territory and duration, in accordance with Article L131-3 of the same code. They are acquired on full payment. Any use beyond them requires written agreement.
Private clients: unless otherwise stated, the images are for personal, non-commercial use (family circle, personal social media accounts).
The author’s moral rights cannot be waived: the author’s name (Vass.psv) is credited wherever the medium allows. The service provider may show some images in their portfolio and on social media, unless the client refuses in the quote or in writing, and always with respect for the image rights of the people photographed.
10Image rights
The client guarantees that they hold the necessary permissions for the people, places, vehicles, brands and works they ask to have photographed or filmed (Article 9 of the French Civil Code). The service provider can supply a model image release for the people concerned to sign.
11Liability
The service provider uses all the professional means needed to carry out the service properly. The service provider cannot be held liable for a delay or impossibility caused by the client (information, access, permissions) or by force majeure within the meaning of Article 1218 of the French Civil Code. In a case of force majeure, the parties look for a new date together; failing that, sums paid for the part not carried out are refunded.
Business clients: the service provider’s liability is limited to the amount of the service concerned. This limitation does not apply to consumers.
12Personal data
Data provided to prepare the quote and carry out the service is processed as described in the privacy policy.
13Complaints and mediation
For any complaint, please write first to contact@vasspsv.com.
If a dispute is not resolved, a consumer client may refer it free of charge to the following consumer mediator (Articles L612-1 et seq. of the French Consumer Code):
[Mediator’s name — to be completed]
[Postal address — to be completed] · [Website — to be completed]
The mediator can only be approached after a written complaint has been sent to the service provider, and within one year of that complaint (Article L612-2).
14Governing law
These terms are governed by French law. If no amicable solution is found, the dispute is brought before the competent court; a consumer may choose to bring it before the court of the place where they lived when the contract was concluded or when the harmful event occurred (Article R631-3 of the French Consumer Code).
